According to Thailand family lawyers, the Thai family law does not currently specifically address formal legal separation agreements.
Couples who desire to undergo a trial separation can create informal agreements that provide for finances, child custody, and disposition of property.
These types of separation agreements may help to establish the beginning date and duration of the separation in a subsequent divorce case. This may be important for establishing a ground for Thailand divorce, the terms or the agreement may also set out factual or matters that may later be used as evidentiary precedent for the Family Court to consider in their decisions regarding these issues in a subsequent divorce case. However, in general, agreements between spouses do not have the same force and are not as legally enforceable as agreements between non- spouses, such as, for example, commercial contracts.
