Facebook cited as Top Source for Divorce Case Evidence

Divorce lawyers are increasingly using social media text posts and photos as evidence in divorce court cases in the past five years, according to a study released by the American Matrimonial Lawyers (AAML).

 81% of America’s top divorce attorneys reveal Facebook is leading the way in producing divorce evidence and it is cited as the top divorce evidence source 66% of the time, Myspace follows with 15%, Twitter at 5% and other social media listed by 14%.

 Information from social networks is potentially good evidence that divorce court judges often will allow into evidence. Currently, more people are sharing personal aspects of their lives on social media, leaving themselves open to much greater examinations of both their public and private lives in a sensitive situation said AAML president Marlene Eskind Moses. If people going through a divorce process publicly post any contradictions to previously made statements and promises, an estranged spouse will certainly be one of the first people to notice and make use of that as evidence.

 Divorcing couples in a contested divorce case in Thailand may need to be aware of just how much social networking can affect their divorce proceedings. Patience and restraint is crucial, anything posted on Facebook, Twitter and other social media can be used as evidence and can sabotage not only court cases and may also affect child custody rights along with other legal rights.
