Judge: ‘Fundamental Human Right’ for Man to Have Sex with His Wife

A judge in England has caused a stir after he said in court that it is a “fundamental human right” for a man to have sex with his wife.

The judge had been asked to impose a court order that would bar a man from having sex with his wife of 20 years who may no longer have the mental capacity to give consent.

Whether or not the woman–who has learning disabilities that have gotten significantly worse with age–can give be considered to give consent was brought to the judge by social services.

If the woman does not have the mental capacity to freely give consent, then lawyers in the case argued that the judge should bar her from being raped.

The judge said even if the order was given to the man, who said he would agree to an undertaking, it would be almost impossible to enforce and if enforced, could send the man to prison for years.

“I cannot think of any more obviously fundamental human right than the right of a man to have sex with his wife,” the judge said. “I think he is entitled to have it properly argued.”

The statement was made during a preliminary hearing. The rest of the hearing will take place in the coming months.
