Arizona the First State to Dictate who gets the Frozen Embryos after a Separation

27771482282_301605b97f_zArizona has just passed a law that will allow frozen embryos to the person who wants to birth them after a couple separates. Nita Farahany a professor of law and philosophy at Duke University considers the ethical implications of the law.

She comments that this law differs from the past, that if one party did not want to birth the embryo then both parties would not be allowed to develop the embryos. The current law would make one of the parties become a genetic parent whether they wanted it or not which, would create “emotional and financial ties” to the child.

She further explains that the new law abolishes the contract that the parties agreed on about the development of the embryos post separation. She is still quite unsure on how the provisions of the law would affect if both parent want the embryo, if one isn’t liable for child support or neither want the embryo.
